YOU ARE RULE 8(a)!

You are Rule 8, the most laid back of all the

Federal Rules of Civil Procedure. While your

forefather in the Federal Rules may have been

a stickler for details and particularity, you

have clearly rebelled by being pleasant and

easy-going. Rule 8 only requires that a

plaintiff provide a short and plain statement

of a claim on which a court can grant relief.

While there is much to be lauded in your

approach, your good nature sometimes gets you

in trouble, and you often have to rely on

your good friend, Rule 56, to bail you out.

It gave me 8(a), too - completely invalidating my high school nickname, "The 12(b)(6) of the South."

Finally an internet quiz for me! My result -- Rule 15 -- seems fitting enough for my slacker personality.

While you might be a defendant's best friend, you aren't exactly polite to others. You have seven separate grounds on which to dismiss a plaintiff's case. You are a bit paranoid, since if you fail to raise your 12(b)(2,3,4, or 7) in a motion or a pleading with one of the other 12(b) defenses or a 12(e) motion, you waive those objections for the rest of trial. Some might say that 12(b) is the biggest bully of the Federal Rules of Civil Procedure, but hey, somebody needs to keep the peace. You might not be the most popular guy in the office, but you're probably the most important."

why anyone but a litigator would be amused by this quiz is beyond me. I vaguely remember some of these things from law school, but I try to stay as far away from procedure as possible. I'm amazed that non-lawyers would take this, although I guess there's a certain absurdist charm to it.

Also 12(b). I'll plead to paranoia, but make an affirmative defense for the impoliteness and importance charges.

I'm pretty sure it's the absurdist charm that makes it funny for me. I have a friend who keeps sending me links to quizzes like, "what tree are you?" This quiz was a breath of fresh air.

Interestingly, I got rule 15 for my real answers, and when I changed to the most unreasonable answers available I got...rule 15 again.

I hang out with some lawyers, they are all litigators. I'll have to ask them if they think I'm a 12(b).

12(b) has a lot of content, some of it trivial and some of it the kind of stuff lawyers use all the time. So hopefully they will find you sufficiently complex to deserve the name.

I think these "What Kind of XXXX are You?" surveys are getting out of hand. Who cares which Tolkien character or planet or football team they are? It's making me nostalgic for plain old horoscopes.

I'm missing something here. I went to the web site.. actually have been there all day trying to find friggen 12(b) that says one must have cause for action or remedy or rather a claim for relief, but can't find that wording. Under 12(b) it is about time to respond and all that ... Someone help please, my case hinges’ on this one point. The friggen state is/ hell has, imposed its will upon me and made no claim except that they don't like it. Even though I am not subject to "their" rules and "laws" of their "legal system" it is always nice to stuff it up their noses as they look down them at me. I hope some time in the near future all these bright minds that love to juggle lives and use a system that should be used for justice and freedom will wake up and put it back in order by holding themselves and the others of their clan accountable to their oaths and positions of trust, before we are under complete dictatorship. I even saw a blip on main stream news that this country is now officially more communist than Russia, China and being compared to North Korea.... Don't believe me? Here is a clue to all those who still believe in Santa Clause and were lied to by all those around them. I'll bet you think the Constitution says "We the People, of the United States,..." it does NOT!!! Read it again! it says "WE THE PEOPLE of The United States," Now replace United States with Microsoft or 3m or any other corp. That’s right look up the code, United States is a corporation! and the Constitution is its corporate charter. We the people got enslaved! We did not swear an oath to uphold the Constitution but those that did are not upholding it!! In fact most don't even know what it says thereby committing fraud! I mean you would say a mechanic that didn't know what a carburetor is was committing fraud and a doctor that didn't know the operation..... OOps pull me into shallow water before I get too deep, because "You can't handle the truth". That’s a good little elf now keep making those widgets for Santa, all day and all night.
